Have you received a phone call where your caller id shows a telephone number and the name of a U.S. State or other questionable name? This is a tactic being used by debt collectors to contact you about a delinquent debt. This tactic is called "spoofing", and it is not legal for debt collectors to do. Spoofing is the use of fake caller id information. From the calls I have monitored, the debt collector uses a foreign service to spoof the collection call. When you answer the call the person will ask for the debtor. When you are acknowledged as being the debtor the call is quickly forwarded to the debt collector's office. Collectors must not use illegal means to contact debtors. Third-party debt collectors are not the only ones guilty of using these tactics. Original creditors are also doing it.
Know your rights. If this ever happens to you, do not answer any of their questions. Send a Validation/Cease and Desist notice certified mail/return receipt requested to the debt collector immediately to stop the harassment. Visit http://1time1.webs.com to see a sample Validation Notice. You can also file a complaint with the Attorney Generals office of your state and the FTC. If all else fails, you can file a lawsuit against the third-party debt collector if the situation warrants. Contact a qualified attorney if needed.
In closing, never be intimidated by a debt collector. Educate and empower yourself to fight back.

Unlike previous years, more and more creditors are taking debtors to court in an attempt to recoup any outstanding debts. Like I said before, respond to all collection notices. Use certified mail with return receipt to preserve your rights in court in case you are sued. No response to collection notices usually equals a default judgment for the creditor.

Did you know that a third party debt collector can purchase your delinquent aged debt from the original creditor for as little as twenty-five cents per one hundred dollars? That is correct, one quarter per $100. Purchasing a $400 debt can cost a debt collector $1. In turn, the original creditor will make a profit of $1, and write the debt off as a loss on it's taxes, or possibly file an insurance claim on the loss. Meanwhile, the debt collector will attempt to collect this debt from you for hundreds of dollars over the amount of the original debt. That is where my Validation/Cease & Desist and Declaration Form comes in. These are powerful tools in stopping unscrupulous debt collectors in their tracks.

Many debt collection agencies are purchasing old debts that are past the SOL (Statute of Limitations). While these debts may be outdated, the debtor still has an obligation to pay the debt. The question is; to whom the debtor has a LEGAL obligation to pay the debt to? With that being said; if you receive notice from a collection agency demanding payment of a debt, have the debt validated prior to making any payment. If the collector has the legal right to collect the alleged debt, he will be more than happy to provide all information requested in the validation process. Otherwise, you will never hear from this collector again. But beware, the collector may sell the debt to another collection agency and the process will start all over again. Always respond to debt collection notices ASAP. If the debt is valid, NEGOTIATE! Never ignore the debt collection notice and let the debt be furnished to the Credit Reporting Agencies.
